{"id":1463,"date":"2018-10-18T10:05:20","date_gmt":"2018-10-18T04:35:20","guid":{"rendered":"https:\/\/www.iilsindia.com\/blogs\/?p=1463"},"modified":"2023-10-30T14:56:02","modified_gmt":"2023-10-30T09:26:02","slug":"medico-legal-case-overview","status":"publish","type":"post","link":"https:\/\/www.iilsindia.com\/blogs\/medico-legal-case-overview\/","title":{"rendered":"MEDICO LEGAL CASE \u2013 AN OVERVIEW"},"content":{"rendered":"<p>WHAT IS MEDICO LEGAL CASE?<\/p>\n<ul>\n<li>A Medico-Legal Case can be defined as a case of injury or ailment, etc., in which investigations by the law-enforcing agencies are essential to fix the responsibility regarding the causation of the injury or ailment.<\/li>\n<li>It is a medical case with legal implications for the attending doctor where the attending doctor, after eliciting history and examining the patient, thinks that some investigation by law enforcement agencies is essential.<\/li>\n<li>It may be a\u00a0legal case\u00a0requiring medical expertise when brought by the police for examination.<\/li>\n<\/ul>\n<p>DOCTOR\u2019S DUTY<\/p>\n<ul>\n<li>Every doctor under law bound by a contract to serve its patient and can not refuse treatment.<\/li>\n<li>Every doctor has to fulfill certain legal requirements in service by compulsion or voluntarily as defined under law.<\/li>\n<li>Medico legal case (MLC) examination and reporting is one of the legal responsibility of all doctors working in a hospital.<\/li>\n<\/ul>\n<p>In the judgment of case Parmananda Katara Vs Union of India, the apex court said:<\/p>\n<p><em>\u201c Every doctor is bound to provide medical aid to the victims irrespective of the cause of injury; he cannot take any excuse of allowing law to take its course\u201d.<\/em><\/p>\n<p>LIST OF MEDICO-LEGAL CASE<\/p>\n<ul>\n<li>All cases of injuries and burns -the circumstances of which suggest commission of an offense by somebody. (irrespective of suspicion of foul play)<\/li>\n<li>All vehicular, factory or other unnatural accident cases specially when there is a likelihood of patient\u2019s death or grievous hurt.<\/li>\n<li>Cases of suspected or evident sexual assault.<\/li>\n<li>Cases of suspected or evident criminal abortion.<\/li>\n<li>Cases of unconsciousness where its cause is not natural or not clear.<\/li>\n<li>All cases of suspected or evident poisoning or intoxication.<\/li>\n<li>Cases referred from a court or otherwise for age estimation.<\/li>\n<li>Cases brought dead with improper history creating suspicion of an offense.<\/li>\n<li>Cases of suspected self-infliction of injuries or attempted suicide.<\/li>\n<li>Any other case not falling under the above categories but has legal implications.<\/li>\n<\/ul>\n<p>PROCEDURE FOR REGISTERING A MEDICO LEGAL CASE<\/p>\n<ul>\n<li>TREATMENT (All legal formalities to be suspended till the patient is resuscitated)<\/li>\n<li>IDENTIFICATION (Whether the said case falls under Medico Legal Case or not)<\/li>\n<li>INTIMATION TO POLICE (if it does fall in this category, then he must register the case as an MLC and\/ or intimate the same to the nearest police station, either by telephone or in writing.)<\/li>\n<li>ACKNOWLEDGEMENT RECEIPT (From the police should be received for future reference.)<\/li>\n<\/ul>\n<p>REPORTING OF MEDICO LEGAL CASE<\/p>\n<ul>\n<li>Reports must be prepared in duplicate on proper pro-forma giving all necessary details<\/li>\n<li>Avoid abbreviations, over writings. Correction if any, should be initialed with date and time.<\/li>\n<li>Reports must be submitted to the authorities promptly.<\/li>\n<li>Medico-legal documents should be stored under safe custody for 10 years<\/li>\n<li>Age, sex, father\u2019s name, complete address, date and time of reporting, time of incident, brought by whom.<\/li>\n<li>Identification marks and finger impressions<\/li>\n<li>All MLC to be informed to the police for taking legal evidence<\/li>\n<li>If the patient is dying, inform the magistrate to record \u2018dying declaration\u2019.<\/li>\n<\/ul>\n<p>CONCLUSION<\/p>\n<ul>\n<li>In any of the\u00a0medico-legal cases, it is the legal duty of the treating doctor to report it to the nearest police station immediately after completing primary lifesaving medical care.<\/li>\n<li>This is in accordance with Section 39 of Criminal Procedure Code of India.<\/li>\n<li>The idea is to initiate the legal proceeding at the earliest is so that maximum evidence can be collected by the police officer.<\/li>\n<li>Quick action by the police also helps to avoid the destruction of evidence by the treating physician.<\/li>\n<\/ul>\n<p>Written By<\/p>\n<p><strong>SOUVIK DHAR<br \/>\nASSISTANT PROFESSOR IN LAW<br \/>\nIILS<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>WHAT IS MEDICO LEGAL CASE?
