{"id":1527,"date":"2019-03-09T12:24:51","date_gmt":"2019-03-09T06:54:51","guid":{"rendered":"https:\/\/www.iilsindia.com\/blogs\/?p=1527"},"modified":"2023-10-30T15:04:21","modified_gmt":"2023-10-30T09:34:21","slug":"refugee-and-asylum-treaties-and-institutions","status":"publish","type":"post","link":"https:\/\/www.iilsindia.com\/blogs\/refugee-and-asylum-treaties-and-institutions\/","title":{"rendered":"Refugee and asylum: Treaties and Institutions"},"content":{"rendered":"<p style=\"margin: 0cm; margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; background: white;\"><span lang=\"EN-US\">The\u00a0<span style=\"color: windowtext; text-decoration: none; text-underline: none;\">Convention<\/span>\u00a0and the\u00a0<span style=\"color: windowtext; text-decoration: none; text-underline: none;\">Protocol<\/span>\u00a0relating to the Status of Refugees define a refugee as a person who \u201cowing to well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion, is outside the country of his nationality and is unable, or owing to such fear, is unwilling to avail himself of the protection of that country; or who, not having a nationality and being outside the country of his former habitual residence . . . , is unable or, owing to such fear, is unwilling to return to it.\u201d In addition to the Convention and Protocol there are a number of other relevant\u00a0<span style=\"color: windowtext; text-decoration: none; text-underline: none;\">human rights treaties, declarations, and other instruments<\/span>. For example, Article 3 of the\u00a0<span style=\"color: windowtext; text-decoration: none; text-underline: none;\">Convention against Torture<\/span>\u00a0provides that no government shall forcibly return \u201ca person to another State where there are substantial grounds for believing that he would be in danger of being subjected to torture.\u201d The\u00a0UNHCR\u00a0is the principal worldwide institution that protects and assists refugees. The UNHCR works with other intergovernmental agencies,\u00a0<span style=\"color: windowtext; text-decoration: none; text-underline: none;\">UNICEF<\/span>\u00a0in regard to child refugees, and many\u00a0<span style=\"color: windowtext; text-decoration: none; text-underline: none;\">voluntary agencies<\/span>. In providing\u00a0<span style=\"color: windowtext; text-decoration: none; text-underline: none;\">transportation<\/span>, housing,\u00a0<span style=\"color: windowtext; text-decoration: none; text-underline: none;\">food<\/span>, clothing, education, and other assistance. The UNHCR has estimated that there are about 20 million refugees and 30 million internally\u00a0<span style=\"color: windowtext; text-decoration: none; text-underline: none;\">displaced persons<\/span>\u00a0in the world. Having\u00a0<span style=\"color: windowtext; text-decoration: none; text-underline: none;\">ratified<\/span>\u00a0the\u00a0<span style=\"color: windowtext; text-decoration: none; text-underline: none;\">Protocol on the Status of Refugees<\/span>, the United States has confirmed its statutory definition of refugees and asylums to the international definition as interpreted by the courts. In order to apply for asylum a person must demonstrate that they have a well-founded fear of persecution based upon their own experience and the experience of similar individuals. Hence, <span style=\"color: windowtext; text-decoration: none; text-underline: none;\">country condition information<\/span>\u00a0is very useful. Beginning in 1996 the India. established an abbreviated procedure in which immigration officials must assess whether the individual who seeks asylum at arrival has a &#8220;well-founded fear&#8221; of persecution.
