Indian Constitution has provided several rights to the people to protect their fundamental rights, but unfortunately, most people are not aware of their rights. Thus, we are providing some laws and the rights<\/a><\/strong> which not only protect people’s interests but also ease their daily life. As taught in all 3 years llb course in west Bengal, also, as per Section 129 of the Indian Motor Vehicle Act, wearing the helmet is a must for two-wheeler riders. Section 128 of this Motor Vehicle Act limits the maximum two riders on the bikes. <\/p>\n\n\n\n

1.Motor\nVehicle Act 1988, section -185, 202:- At the time of driving if your 100ml.\nblood contains more than 30mg. of alcohol then the police can arrest you\nwithout a warrant.<\/p>\n\n\n\n

This law\nalso says that if the traffic police officer snatches the key from the car or\nmotorcycle, it is illegal. You have the full right to launch a Legal proceeding\nagainst the officer.<\/p>\n\n\n\n

2. Criminal\nProcedure Code, Section 46:- No woman cannot be arrested before 6 A.M. and\nafter 6 P.M.<\/p>\n\n\n\n

3.  Indian Penal Code, 166 A:- As taught in all 3\nyears llb course in west Bengal, a Police officer can\u2019t refuse to lodge an FIR\nif he\/she does so they could be jailed for up to 6 months to 1 year.<\/p>\n\n\n\n

4.  Domestic Violence Act, 2005:- If a young boy\nand a girl want to live together in a \u201clive-in relationship\u201d, they can do so\nbecause it is not illegal. Even the newborn from this relationship is also a\nlegal son or daughter and this newborn have the full right in the assets of\nhis\/her father.<\/p>\n\n\n\n

5. Police Act, 1861<\/a>:- A police officer is always on duty whether he\/she wearing a uniform or not. As taught in all 3 years llb course in west Bengal, if a person makes a complaint to the officer, he\/she could not say that he can\u2019t help the victim because he\/ she is not on duty.<\/p>\n\n\n\n

6.\nMaternity Benefit Act, 1961:- No company can fire a pregnant woman. It may be\npunishable by a maximum of 3 years of imprisonment. If the company (Government\nor private) has more than 10 employees then the pregnant women employee is\neligible to get 84 days paid maternity leave.<\/p>\n","protected":false},"excerpt":{"rendered":"
