Custodial Death And Torture

Indian Constitution provides one of the most important fundamental rights i.e. Right to Life and Personal Liberty which clearly speaks about the person’s right to live fully with proper liberty and dignity. But there are situation where these rights are not at all provided to the public at large. In recent debatable issues there is a huge discussion over Custodial Torture and Custodial Death. Custodial Torture and Custodial Death is simply a phenomenon where police use to torture the people who are in prison or jail. Sometimes such torture leads to their death also. They have to face a severe kind of punishments i form of beating, harassing, mentally and physically in a very cruel and gruesome manner. Supreme Court of Indian in the landmark judgment of D.K. Basu case has given numerous guidelines regarding the proper treatment in the prison to the person who are detained or in police custody. At international level there is one convention which also speaks about the same as Convention Against Torture which also lays down several guidelines regarding the same. There are still instances where the provided guidelines are not fully adopted and implemented in the present scenario. Implementation of all the guidelines regarding the same shall be incorporated in a very strict sense and provide the safety to the people who are detained and give them the fullest right of life as they also posses rights to life with personal liberty.
