EMERGENCE OF CYBER CRIME

Abstract

Knowledge of the law can save a person from being both a victim and an offender. As a result, it is the responsibility of every person in our country to understand and follow the law. Basic legal studies are important for the inhabitants of this area, and the Indian Institute of Legal Studies Cooch Behar plays a significant part in shaping them.

Introduction

Education makes a person wise and capable. Legal education transforms a man into a law-abiding citizen of his country. In Cooch Behar  it may be considered that the people of this District had an urgent need for a coochbehar law college for the benefit of those who wanted to pursue a profession in the area of law. There was no law college in Cooch Behar prior to 2019, however the first law college in Cooch Behar was founded in 2019 under the auspices of the Ashwini Chowdhury Educational Trust. The Institute’s principal goal is to provide comprehensive legal education. Apart from providing legal education it is also important to know the present menaces of cyber crime which is growing rapidly.

Menaces of Cyber crime

Since cybercrime is becoming more prevalent, the idea of cybercrime is still evolving. “Cybercrime” refers to unlawful activity in which a computer or network is used as a weapon, a target, or a venue for criminal activity. This word not only applies to criminal acts, but also to common offences in which computers or networks are used as means to execute them. Since there is no   such thing as geolocation in cyberspace, disputes occur when Netizens’ rights are seen from the eyes of residents of physical space. A felony can happen where and only where the chance presents itself, as the phrase goes in criminology. Until recently, we were just aware of typical forms of crimes such as homicide, kidnapping, stealing, blackmail, burglary, dacoity, and so on. However, with the growth and progress of science and technology, devices such as computers and services such as the internet have come into being. The internet has created a brand new technological heaven for individuals, both good and poor, smart and ignorant, to access and communicate with people from all over the world, regardless of geography or demographics. When the internet’s virtues fall into the wrong hands or are exploited by individuals with dirty minds and evil motives, it becomes a cyber crime. In recent years, there have been many reports of copyright piracy, hacking and breaking, worm attacks, and outright hoaxes, among other things. Computer crimes are spreading like mushrooms as a result of the rapid global adoption of the internet. Law enforcement authorities have been irritated with lawmakers’ failure to keep cyber crime laws up to date with the fast-moving technology curve. Simultaneously, policymakers must strike a balance between conflicting values such as human rights such as privacy and free expression and the need to protect the security of the world’s public and private networks. It would be difficult for law enforcement and judicial officers to deal on the investigation and find a cure after a felony has occurred. In some ways, cybercrime will be the only source of crime, and in others, it will coexist with traditional crime. In this dissertation I shall focus on the various kinds of emerging cyber threats around the world as well as in India, I will also discuss the existing legal framework in India and Criticize the same and last but not the least we will give emphasis on what would be the probable measures that can be taken into consideration to curb the menaces of cyber- crime. The review of the existing literature not only provides clarity of concept and understanding of different aspects of the subject but also helps avoid repetition. It helps in identifying problem zones. It also helps in formulating research methodology. A number of books, monographs, reports, research papers and articles deal with the subject of prevention and control of cyber crimes.

Conclusion

       Keeping in view of the above we can say that coochbehar law college in the name of Indian Institute of Legal Studies Cooch Behar is spreading legal education through its various legal aid camps, legal awareness programmes and seminars about the menaces of cyber crime.
