Rights And Obligations Of Refugee’s Under International Law

The term refuge means shelter or protection from distress to one who is in difficulty whereas Refugee means one who is in distress and flees for shelter and protection to another Country especially from religious prosecution. They are the persons who are unwilling to remain in Country where they are presently because of fear of prosecution on accord of religion, race, nationality, political believe or otherwise. Reason behind their existence is natural forces (drought, earthquake etc.) or war. The most important reason is hatred or discriminatory behaviour of the Authorities of the Country where they are towards them. At one point of time, India has seen huge influx of refugee population. The issue of refugee’s is not the concern of one Nation rather it is the concern International Community. They all are the human beings and possess human rights under foreign nation too. The human rights are the birthrights of a person, which are in nature of inherent and inalienable. No one can deprive of human rights. Keeping in Mind this concept of Human Rights League of Nation in the year of 1921 appointed  a High Commission to co-ordinate the action taken in different Countries on Refugee issue, to decide legal status of refugee, allocate them in Countries who will accept them and also to find out means of livelihood and to undertake relief work for them. Then, the Convention Relating to Status of Refugee adopted in 1933. United Nation accepted Genocide as a crime under International law in the year of 1946 and penalises genocider’s before International Court of Justice. In 1951, Convention Relating to Status of Refugee was adopted. In 1996, it was reported by United Nation that 13 million people had flee from their countries. In 1967, a Protocol Relating to Status of Refugee was adopted. The Convention of 1951 conferred certain rights to refugees as to non discrimination, religion, marriage, acquiring movable and immovable Properties, artistic and industrial properties, formation of non political and profitable association, approach to the Court of the Country, right to employment and wages etc.

The rights are correlative with duty always so with rights, there are obligations too. Few obligations or duties are imposed on refugees that are duties to the Country, which refugees resides. They are duty bound to behave and conduct in accordance to the laws and regulations of the Country.
