SEC. 66A OF THE INFORMATIONN TECHNOLOGY ACT, 2000 ARE VIOLATES FUNDAMENTAL RIGHTS

Information technology is established relationship between computer technology and communication technology, information technology system rapidly increased and also misuse of this system. Sec 66A of Information technology act, added in 2008 Amendment, there are various view provides by jurist that, whether this section are violates fundamental right of the constitution. And on the other hand reasonable restriction imposed upon the fundamental right are valid.

Sec 66A of Information Technology Act, deals with Punishment for sending offensive message through communication device, here question arise what category of message comes under unpleasant message,  When one sends either by means of a Computer, mobile phone, Computer System, Computer Network or using Mobile Phone, Smart Phone, iPhone, iPad, Tablet, Smart Devices, or any other communication devices.

Cyber crime has become new challenges for Indian law and its machineries in criminal as well as civil matters. Cyber crime happened in cyber space not in real space that is why it is difficult to prevent cyber crime. There is an urgent need of change in the views in accordance with positive reinforcement and confidence on the widespread global platform.
